1. Agreement to Terms
By accessing or using the pdfkitt API service (“Service”) operated by pdfkitt (“we”, “our”, “us”) at pdfkitt.dev, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free-tier users and paid subscribers.
2. Description of Service
pdfkitt provides an HTTP API that converts HTML documents to PDF files using a headless Chromium rendering engine. The Service is intended for developers building applications that require programmatic document generation, such as invoices, reports, contracts, and tickets.
3. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to:
- Generate, distribute, or store documents that contain illegal content, including but not limited to child sexual abuse material, content that incites violence, or material that violates applicable export control laws.
- Distribute malware, ransomware, exploit code, or other malicious payloads embedded in or linked from generated PDFs.
- Perform high-volume scraping operations — i.e., using the API primarily to render and extract third-party web content at scale rather than to generate documents from your own HTML.
- Circumvent, disable, or interfere with security features of the Service, including rate limits and authentication mechanisms.
- Resell or sublicense raw API access to third parties without our prior written consent. Building a product on top of the Service is permitted; white-labeling the raw API endpoint is not.
- Attempt to reverse-engineer the Service infrastructure, probe for vulnerabilities without written authorization, or perform load testing in excess of your plan’s rate limits.
- Impersonate another person or entity, or provide false registration information.
We reserve the right to suspend or terminate accounts that violate these prohibitions without prior notice and without refund.
4. Account Registration and API Keys
You must create an account to obtain an API key. You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under your account. You must notify us immediately at support@pdfkitt.dev if you suspect unauthorized use of your key. You may revoke and regenerate API keys at any time from your dashboard.
5. Service Availability
We strive to maintain high availability and target 99.9% uptime as a general goal. However, we do not provide a formal Service Level Agreement (SLA) on any plan, including paid plans. Scheduled maintenance, infrastructure failures, and third-party provider outages may cause interruptions. The Free tier has no uptime commitment whatsoever.
We will make reasonable efforts to communicate planned maintenance windows in advance via our status page and email notifications. Unplanned outages will be reported on our status page as soon as practicable.
6. Plans, Billing, and Payment
Paid plans are billed monthly or annually in advance. All prices are in US dollars. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.
Overage charges. On paid plans, usage above your monthly PDF limit is charged at $0.01 per additional PDF. On the Free plan, generation is paused when you reach the limit until the next billing cycle.
Refund policy. We offer a full refund of your first paid month’s subscription fee if requested within 7 days of the initial charge. Subsequent billing cycles are non-refundable. Overage charges are non-refundable. To request a refund, email support@pdfkitt.dev with your account email and the reason for the request.
Annual billing. Annual plans are discounted (approximately 17% off the monthly rate). Annual subscriptions are not eligible for a refund after the 7-day first-payment window has passed.
7. Cancellation
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; you will retain access to your plan features until that date. We do not prorate partial months unless required by applicable law.
We reserve the right to downgrade your account to the Free tier rather than deleting it, so that your API key and usage history remain accessible.
8. Termination by Us
We may suspend or terminate your account immediately and without notice if you violate Section 3 (Acceptable Use) or any other material provision of these Terms, if your payment fails and is not resolved within 7 days, or if we are required to do so by law. We may also terminate any account at our discretion with 30 days’ written notice for any other reason.
Upon termination, your right to access the Service ceases immediately and we will retain your data only as required by applicable law or our Privacy Policy retention periods.
9. Intellectual Property
The Service, including its software, design, trademarks, and documentation, is owned by pdfkitt and protected by intellectual property laws. Your use of the Service grants you no ownership of Service components.
You retain all ownership of the HTML content you submit and the PDF documents generated from it. You grant us no license to your content beyond what is necessary to render the PDF and return it to you (i.e., transient in-memory processing only — see our Privacy Policy).
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PDFKITT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
12. Indemnification
You agree to indemnify, defend, and hold harmless pdfkitt and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service in violation of these Terms or applicable law.
13. Changes to Terms
We may update these Terms as the Service evolves. Material changes will be communicated via email to registered users at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. The “Last updated” date at the top always reflects the current version.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.
